The U.S. Department of Justice has failed to represent the best interests of the American people in their lawsuit against Big Tobacco. That's why the Campaign's sister organization, the Tobacco-Free Kids Action Fund, and its partners, were granted a Motion to Intervene in the lawsuit. As a party to the lawsuit, the Action Fund and its partners can make the strongest arguments possible on how Big Tobacco should be punished if they are found guilty of continuously deceiving the American people. The Action Fund and its partners will file their second brief as a party to the lawsuit on September 26, 2005.

While the Action Fund and its partners are working in court to influence this case, we need to keep the pressure on the Bush Administration so they don't further weaken the government's case. It is time they stop playing politics and return to representing the best interests of the American people.

Subject:Stop Playing Politics with America's Health
Dear Attorney General Gonzales:

I was outraged to learn that the U.S. Department of Justice (DOJ) failed to reverse its capitulation regarding the smoking cessation remedy asked for as part of the lawsuit against Big Tobacco. The Justice Department continues to ask for a completely inadequate cessation program, cutting $120 billion from the program its own expert witness recommended. The Department of Justice recommendation would also eliminate specific restrictions on advertising that affects kids.

At the same time, other important parts of the proposed remedies were left unchanged, which if fully and effectively implemented could prevent future industry wrongdoing and significantly reduce the death toll from tobacco in our country.

I urge you to take every possible step to encourage the Department of Justice to correct the deficiencies in its approach and resist any efforts by the tobacco industry to reach a weak settlement. It has been widely and reliably reported that the government's sudden weakening of the cessation remedy was the direct result of efforts by Associate Attorney General Robert McCallum, a political appointee, pressuring the Justice Department lawyers to change their strategy and let the tobacco industry off the hook. Do not let politics continue to interfere in this historic case. This trial is an opportunity to hold the tobacco companies legally accountable for their wrongful behavior and reduce tobacco's terrible toll on the health of our nation.

It is essential that political interference not undermine the effort to seek comprehensive remedies that can prevent and restrain future industry wrongdoing. Please, don't play politics with America's health.
